FAL are boutique specialists in corporate and commercial law, with particular expertise in collaboration, research & innovation, intellectual property (IP) and information technology (IT).
Prior to establishing FAL in 1993, our founding partners, Peter Francis and Jenni Lightowlers, were the in-house legal team responsible for Sirotech Ltd, CSIRO’s former commercial arm. As such, the firm was borne from acting for the Commonwealth, with CSIRO becoming the first major client of the firm.
IP is of critical and growing interest to all public and private entities. FAL acts for a significant client base in this field, including start-up companies, a substantial proportion of Australia’s research bodies (CRCs, Universities), The State of Victoria and ASX-listed entities.
Whilst the spectrum and scale of IP related advice varies across FAL’s client base, it is of crucial importance to ensure that our clients obtain and protect IP to meet their needs and do not infringe the IP of others. Providing the right advice not only requires an in-depth understanding of IP law, but also of what IP our clients have and how this may (or may not) fit with their objectives.
FAL has expertise across all areas of intellectual property (IP) rights. FAL has advised clients in relation to IP ownership and licensing, patent disputes, potential copyright infringement matters, plant breeders rights and has filed and prosecuted patents and trade marks for government organisations, universities, cooperative research centres, and SMEs alike.
FAL has a database of over 1,100 client trade marks and regularly advises clients on trade marks, branding and related areas of the law, including applications for registration, oppositions, cancellations and renewals of trade marks and designs with IP Australia and in other jurisdictions under the Madrid Protocol; domain, business and company names; passing off and misleading and deceptive conduct; and establishing certification trade marks.
FAL also proivde patent attorney services and can cover technology fields as varied as medical diagnostic devices, building and construction devices, bulk transport, and general engineering. Our patent attorney, Rhys Munzel has a background in chemical engineering and previously worked for over ten years with the Australian Patent Office, where he abitrated sensitive patent disputes between multinational companies.
